Terms & Conditions

Introduction

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") are intended to apply to orders (“Order(s)”) placed with the Seller identified above through its website https://parfumshenryjacques.co... referred to as the "Site"). They define the contractual conditions applicable to sales made by this Seller, to purchases made by the customer (“Customer”). Any Order necessarily implies acceptance of these GTC. 1. Our products

Before placing an Order, the Customer may take note of the essential characteristics of the product(s) (“Product”) he or she wishes to order.

The products on sale on the Site are manufactured in accordance with the laws of the United Arab Emirates. To the extent possible under applicable laws, the Seller disclaims all liability in relation to any non-compliance with the legislation of the country in which the Product is delivered. The Customer hereby warrants that it will comply with all applicable laws in relation to delivery of the Product as applicable in the country of delivery.

The Seller cannot guarantee that the information on the packaging of the products is translated into all languages. However, this information is available on the Site at least in English and Arabic. In the event of any inconsistency or different interpretation between the English text and Arabic text, the English text shall prevail and the relevant Arabic text shall be deemed to be automatically amended to conform with and to make the relevant Arabic text consistent with the relevant English text.

2. Placing the Order

2.1. The Customer must ensure that he or she uses a recommended browser that accepts the cookies necessary for the proper functioning of the Site.

2.2. To order a Products on the Site, the Customer must do the following:

  • choose the Product he or she wishes to order from the Seller's online catalogue by clicking on the "ADD TO CART" button. The Customer can access the contents of the basket at any time before confirming the Order, in order to make any changes (in particular deleting the selected Product or changing the quantity of the selected product);
  • continue by clicking on the "CONTINUE TO CHECKOUT" button to validate his or her selection of product(s);
  • add additional services such as "gift wrap" or "perfume box" and finally finalise his total basket by clicking on the "VALIDATE BASKET" button;
  • identify himself or herself, indicate his or her chosen delivery address, chosen method of delivery, chosen billing address and chosen method of payment.

2.3. The Customer is responsible for ensuring that the information he enters is complete and accurate. In the event of a data entry error, the Seller shall not be held liable if the Order cannot be delivered. At the time of ordering, the Customer undertakes to check the summary of his or her Order and the information entered.

2.4. To be able to finalise his or her Order, the Customer declares that he or she has read these GTC and thus acknowledges having received all the pre-contractual information concerning the characteristics, price and conditions of purchase of the products sold and having accepted them, by ticking the box provided for this purpose. The Order is finalised by clicking on the "PAY SECURELY" button. This is when the distance selling contract between the Seller and the Customer is established, which implies the obligation of payment by the Customer. Each Order thus validated is irrevocable and cannot be called into question by the Customer, in accordance with the provisions of these GTC

2.5. Once the payment has been validated, a confirmation of the Order is sent to the Customer by e-mail, on which will appear the Order number and, as a reminder, the total amount paid. This document will include a link to download these GTC. In accordance with applicable law, title to the Product will pass from the Seller to the Customer on payment of the Product by the Customer.

3. Payment

3.1. Sale prices

The selling prices of the Seller's products on the Site, indicated in United Arab Emirate Dirham (AED) and excluding VAT, are those applicable at the time of the Customer's Order. They do not include shipping costs.

Prices may be modified by the Seller at any time without prior notice, it being understood that the items ordered will be invoiced on the basis of the price in force at the time of payment of the order, subject to the availability of the products selected.

If the VAT rate is modified, either upwards or downwards, this change may be reflected in the price of the articles.

In the event of a request for shipment outside the United Arab Emirates, customs duties or other local taxes or import duties may be payable. These duties and sums are at your charge, they will be indicated to you and included in your total payment.

3.2. Shipping costs

The delivery address taken into account is the one indicated by the Customer at the time of his or her Order.

In all cases, if shipping costs exist, they shall be indicated before the Customer validates the Order and shall depend on the delivery location and shipping method chosen by the Customer from among the Seller's proposals.

3.3. Terms of payment

The Customer will process the payment for the Product when the Order is placed before the Product is shipped. No discount for early payment is granted. All Orders are payable in Dollars USD AED. In the event that the payment is not equal to the total amount of the Order, only the paid products will be shipped.

The Seller does not have access to any data relating to the user's means of payment. Payment is made directly to the bank.

The Customer guarantees the Seller that he is entitled to use the chosen means of payment.

The following payment methods are available on our Site:

Online payment by credit card (CC)

The Customer can pay for his or her Order directly on the Seller’s online shop with CC (Mastercard, Visa or American Express or Paypal). During the final validation phase of the Order, you must indicate your credit card number as well as its validity date and the cryptogram located on the back of the card (last 3 digits located on the signature panel). At no time should you indicate your confidential code.

To ensure their security, this payment information is entered in encrypted sections and all the information transmitted is coded. None of this information is transmitted unencrypted on the Internet.

4. Reasons for cancellation of orders by the Seller

4.1. Sales reserved for private individuals

The Orders that can be placed on the Site are strictly reserved for non-professional individuals for their own use (or for gift purposes within the family circle). Consequently, the Seller only sells the Products in quantities corresponding to the average habits of a household. Thus, the Seller may legitimately refuse or cancel any Order made on the Site, in compliance with applicable law, in particular where the number of products in one or more cumulative orders by the same Customer does not correspond to a usual volume or which could suggest the performance of a commercial activity in relation to the Products which is the subject of the Order.

4.2 Unavailability

Products may be purchased as long as they are presented by the Seller on the Site and within the limits of available stocks. In the event of total or partial unavailability of products after the Order has been placed, the Customer shall be informed as soon as possible by e-mail by the Seller of the unavailability of the product and of the total or partial cancellation of the Order.

4.3. Contrary local legislation

The Seller reserves the right not to honour, and therefore to cancel in whole or in part, any Order placed for a country in which there are specific local regulations that it knows to be contrary to the import of the products sold.

4.4. Dispute situation

The Seller also reserves the right to cancel any Order from a Customer with whom there is a dispute over the payment of a previous Order.

4.5. Error on the price

In the event of a price error, the Customer shall be contacted by the Seller as soon as possible and the Order in question shall be cancelled.

4.6. Risk of fraud

In order to limit fraud and in the interest of its Customers, the Seller carries out checks on Orders placed on its Site. Thus, in case of doubt about the authenticity of an Order, the Seller reserves the right, in order to accept the sale, to ask the Customer to prove his identity (passport, national identity card or driving licence). In this case, the Order will be processed as soon as these documents are received. The Seller reserves the right to cancel the Order in the absence of receipt of these documents within 10 days or in the event of receipt of documents deemed to be non-compliant.

4.7. Effects of cancellation of the Order by the Seller

In the event of a total cancellation, the Customer shall receive a full refund of the sums paid.

In the event of partial cancellation, the Customer shall be refunded the sums corresponding to the price of the product(s) to be delivered and the delivery costs.

5. Delivery

5.1. Territories

The Order and the delivery of the products is only available in the GCC countries except Qatar, as available in the choice of delivery at the time of the Order on the Site.

5.2. Delivery times

Delivery means the transfer to the Customer of physical possession of the goods.

Delivery times correspond to the time taken to take charge of the Order, plus the time taken to prepare the parcel and the time taken to transport it. It should be noted that deliveries are only made during the service hours of the transport companies, except for the choice of express delivery, no delivery is possible on Fridays and UAE public holidays.

For shipments in the GCC, the average delivery time is indicated below, knowing that the maximum legal delivery time is 30 days from the date of purchase online.

  • 10days on working days from the order confirmation for shipments by standard SMSA Express

These delivery times are given as an indication and subject to the availability of the articles. In the event of a foreseeable extension of the delivery time, the Seller undertakes to inform the Customer as soon as possible and by any means so that the latter can choose to maintain or cancel the Order in whole or in part.

Regardless of the delivery method chosen, the Seller shall not be held responsible for the consequences of any events beyond its control, in particular cases of force majeure (including any events that occur directly or indirectly as a result of the COVID-19 pandemic) or the fault of the carrier, which would tend to delay or prevent the delivery of the products ordered.

Under no circumstances may the delay in delivery result in the payment of damages to the Customer.

The seller reserves the right to split deliveries, it being understood that in this case no additional shipping costs will be applied to the Customer.

6. Right of withdrawal

Important: For hygienic reasons, the right of withdrawal does not apply to cosmetic products, including perfumes, that have been opened (opening system as proof - unsealed lid, tamper-evident label as proof).

6.1. Definition

The Customer has a period of 14 (fourteen) days, starting from the day following the receipt of his or her Order, to exercise his right of withdrawal, without giving any reason or having to pay any penalties. When the period expires on a Friday, Saturday or UAE public holiday, it is extended until the next working day.

After being informed of his choice to exercise his right of withdrawal, the Customer has another 14 (fourteen) days to return the product or products concerned by the withdrawal. No goods may be returned to the Seller without his prior notification.

6.2. Refund and return costs

In the event of exercising the right of withdrawal, the price of the product(s) purchased and the shipping costs shall be refunded to the Customer.

However, the Customer is responsible for the cost of returning the product(s) to the Seller, bearing in mind that the conditions for returning the product(s) must be similar to those for the original shipment.

6.3. Terms and conditions of return

The products subject to the right of withdrawal must be returned in accordance with the Seller's return instructions.

They must be returned in their original condition, intact, complete (original packaging, instructions, warranty certificate, accessories, etc.), clean and in a condition that allows them to be sold.

In the event of damage to the product resulting from improper handling by the Customer, the Customer may be held liable.

6.4. Exercising the right of withdrawal

In order to exercise this right, the Customer must, within the aforementioned period of 14 days, notify the Seller of his decision to withdraw from this contract / his Order by means of an unambiguous statement (e.g., letter sent by post or e-mail), ideally in accordance with the model withdrawal form below, by writing to: order.online.mea@parfumshenryjacques.com

The Seller will contact the Customer as soon as possible to verify the request and propose, if necessary, an alternative. After confirming the validity of the withdrawal, the Seller shall reimburse the Customer, without undue delay, the amount corresponding to the product which is the subject of the withdrawal, including the standard delivery costs and, in any event, no later than 14 (fourteen) days following receipt by the Seller of the returned goods. The costs of any return of the product shall be borne by the Customer.

The Customer must return the goods which are the subject of the withdrawal without undue delay and, in any event, no later than 14 (fourteen) working days after the Seller's confirmation by email that his withdrawal request has been taken into account. This period shall be deemed to have been respected if the Customer returns the goods before the expiry of the 14 (fourteen) day period, at his or her own expense and via an appropriate delivery method, to the following address: CHJ TRADING PERFUMES – DUBAI MALL PERFUMERY & CO FASHION AVENUE

The Seller will proceed with the refund using the same means of payment as for the initial transaction, unless a different means is expressly agreed; in any case, this refund will not incur any costs for the Customer.

7. Legal guarantees

All products on sale on our Site benefit from the legal guarantee of compliance and the guarantee against hidden defects. The Customer may therefore return defective or non-compliant products free of charge:

COMPLIANCE - The Seller applies in any case the provisions of the legal guarantee of compliance of the good to the contract, in accordance with applicable laws.

Thus, the Customer has a period of 2 years from the delivery of the goods to act, except for second-hand goods (exhibition items) for which the period is six months.

The Customer may choose between repairing or replacing the goods.

In order to assert his rights under the legal guarantee of conformity or against hidden defects of the thing sold, the Customer must, on pain of losing his rights, return to the seller a good in a good state of cleanliness and hygiene.

The guarantee will not apply to visible defects and does not cover products damaged during transport or due to misuse or deterioration caused intentionally by a user or modifications made at the Customer's initiative.

8. Responsibilities

8.1. The Seller reminds that:

- unemancipated minors are incapable of contracting. Orders intended for minors must therefore be confirmed by the parental authority

- Orders that may be placed on the Site are strictly reserved for non-professional individuals for their own use (or for gift-giving purposes within the family circle).

Prior to placing an Order, the Customer declares that he is ordering as a private individual and not for professional or economic purposes, and that he has the full legal capacity to enter into a commitment under these GTC. The Seller shall in no way be required to verify the legal capacity of Customers, so that if a person without legal capacity were to order items from the Seller, his legal guardians shall assume full responsibility for this Order (in particular, to honour the payment of the price).

8.2. The Seller invites its Customers to check the apparent condition of the package and the products on delivery and to refuse any package that is damaged and to notify its Customer Service Department, in writing and in detail, of their reservations within 3 days, keeping proof of this writing. Otherwise, the Seller considers that the Customer has received the products in a condition that gives him complete satisfaction.

8.2.1. In the event of a problem with the package (e.g., damaged package, open package, traces of liquid, etc.) or with one or more of the products ordered (e.g., missing or damaged product, etc.), the Customer must

-either refuse the package and declare the anomaly to the deliverer. If the anomaly linked to the transport is confirmed by the Customer Service, the Order will be cancelled and the Customer reimbursed

-accept the package and unpack it in the presence of the delivery person, write precise and complete handwritten reservations on the delivery note given to the delivery person (note that the only mention "subject to unpacking" is considered too general and imprecise), send a letter, by registered mail with acknowledgement of receipt, of motivated protest to the carrier within three (3) days from receipt and inform the seller by e-mail or registered mail within three (3) working days following the delivery of the Order.

Failure to comply with this procedure shall preclude any recourse against the carrier and the Seller and the Customer shall not be entitled to any reimbursement or to request a new delivery of the products ordered.

8.2.2. In the event of any anomaly concerning the contents of the package (e.g., missing product), the Customer must contact Customer Services by e-mail at order.online.mea@parfumshenryjacques.com.

8.2.3. Any complaint must be made within 6 months of receipt of the Order. The Seller shall not be held liable in the event of total or partial non-performance of its obligations, where such non-performance is due to the act of a third party, to a fault of the Customer or to the occurrence of an event of force majeure as defined by applicable laws, or to the occurrence of an event that is not reasonably under the exclusive control of the Seller (partial or total strike of the transport delivery services, flooding, fire, epidemic, pandemic, attack, etc.). The Seller shall not be held liable for any direct or indirect damage related to the use of the Site. In all cases, the Seller's liability is limited to the amount of the Order paid by the Customer (excluding any taxes, import duties and shipping costs).

10. Applicable law

These GTC are subject to change at any time. To the extent practicable, we will notify you of any cancellation, suspension or termination of these GTC that, in our opinion, would materially adversely affects your rights or obligations. The new general terms and conditions of sale will only apply to sales made after the modification.

The law of the Dubai International Financial Centre (DIFC), United Arab Emirates shall apply to these GTC. Any difficulty or dispute will fall under the exclusive jurisdiction of the Courts of the DIFC.
